TERMS AND CONDITIONS
I. APPLICABILITY TO CUSTOMERS AND DEFINITIONS
The following General Terms and Conditions apply, as amended when the order is placed, to all deliveries between us and a consumer.
A ‘consumer’ in the sense of these General Terms and Conditions is any natural person concluding a transaction for a purpose which cannot be connected to their commercial or independent professional activity.
II. CONCLUSION OF A CONTRACT, STORAGE OF THE CONTRACTUAL TEXT
The following provisions for the conclusion of a contract apply to orders placed through our online store at www.mdt-tex.com.au.
Any contracts concluded shall be with the following company: MDT Australia Pty Ltd., E Shed, Fremantle 6160, Western Australia. The depiction of the products in our online store does not represent a legally binding offer, but rather a non-binding online catalogue. By clicking on the order button you are submitting a binding order for the goods contained in your basket.
The following provisions apply when an order is placed in our online store: by successfully completing the order process in our online store, the consumer is submitting a binding order. The order will be both confirmed and accepted immediately after it is submitted by means of an automated email. The purchase contract will be concluded once this email confirmation is sent. Unless you opted to pay by credit card. In this case, the contract will be concluded once your account is charged (upon conclusion of the order). Unless you opted to pay by PayPal. In this case, the contract will be concluded once your payment instructions are confirmed by the payment service provider. III. PRICES, SHIPPING COSTS, PAYMENT, MATURITY
The prices indicated include GST and other price components. This excludes shipping costs. Please contact us to discuss your preferred shipping methods.
Delivery times may vary depending on the destination country. Furthermore, depending on the destination country, standard customs duties may be charged.
The consumer can choose to pay in advance, by bank transfer, PayPal and by credit card (Visa, Mastercard).
PAYMENT IN ADVANCE
You can pay in advance by bank transfer. If the goods are in stock, we will ship your order immediately after receiving your payment and having discussed shipping methods with you. Please transfer the total order amount to our account. We will send you our bank details in the confirmation email.
PayPal is an online payment service which you can use in online stores to pay securely, easily and quickly – and free of charge and with (unlimited) PayPal Buyer Protection. Safe: Your bank details and card information are only stored by PayPal. Thus, they are not transmitted over the Internet every time you purchase items online. Easy: You can pay with two mouse clicks. PayPal already has your bank and card details so you don’t need to enter them every time you make a purchase. Fast: PayPal payments are made quickly. Then the seller can immediately dispatch the goods and you normally receive them earlier.
You can easily and securely conclude the order with a credit card payment. We accept VISA and Mastercard. The amount will be charged to your account once the order is completed.
Unless clearly stated otherwise in the product description, all of the articles we offer can be delivered within 1-2 weeks.
If the consumer opts to pay in advance, we will not dispatch the goods before we receive the payment.
Our shipments are carefully inspected before leaving our warehouse but if upon delivery the goods are damaged or defective, please let us know within the same day. If freight damage is reported a considerable time after delivery took place, we may not be able to offer a free replacement due to the fact that damages could have occurred during shipment.
Damages or lost orders should be resolved with the courier and we are not responsible for goods that are damaged in transit or not received. Replacement of damaged or lost items is made at the discretion of mdt-tex.com.au. We recommend you to get insurance with the courier for your order shipment.
V. RETENTION OF TITLE
We reserve ownership of the goods until the purchase price is paid in full.
VI. RIGHT TO CANCEL
If you are not satisfied with your purchase within 48 hours of delivery then please contact us to discuss your concerns. We always try to assist you as well as we can to find the best suitable solution for both parties.
Please choose your order carefully as we do not provide a refund if you change your mind. We also recommend that you check all dimensions to ensure your umbrella is the right size for your space. Common things to check can include furniture clearances, doorways or fences. If in doubt, please contact us to assist and clarify.
If any goods are faulty, then we will meet our obligations to provide a remedy as per our warranty terms and the Consumer Guarantees Act.
Returns are to be sent exclusively through the shipping company which delivered the package, and the consignment note or label located in the package must be used. All documents which could be of use when you return the items are contained in the package.
Custom made items ordered by the customer cannot be cancelled once confirmed and in production, and are non-returnable once delivered.
VII. COST ASSUMPTION AGREEMENT IF THE RIGHT TO CANCEL IS EXERCISED
If you exercise your statutory right to cancel as described in the policy above, we will impose the following item return costs on you: you must bear the standard return costs if the delivered item matches the item you ordered.

After your order or the contract has been completed, your data will get blocked and will be deleted after expiry of the periods provided by tax law and trade regulations, unless you have granted your approval to use the data after such period. If you have registered for our newsletter, we will use your e-mail address for our own advertising purposes even after the period of contract execution. This can simply be undone by unregistering from our newsletter.
We do not and will not sell or deal in personal or customer information. We will never disclose your personal details to a third party except the necessary information required by providers of products or services you have purchased or to protect the rights, property or safety of MDT, our customers or third parties or if required by law.
We may, however, use in a general sense, without any reference to your name, your information to create marketing statistics, identify user demands and to assist it in meeting customer needs generally. In addition, we may use the information that you provide to improve our website and services but not for any other use.

Please be advised that data privacy rules and policies regarding data privacy, e.g. Google’s policies, may change on an ongoing basis. That is why it is both recommended and required, to keep yourself updated about changes in the relevant regulations and the policies applied by companies, e.g. Google.
